DISTANCE SALES AGREEMENT
This Distance Sales Agreement ("Agreement") has been concluded electronically between the Seller and the Buyer identified below in order to determine the rights and obligations of both parties regarding the sale and delivery of products purchased through the website www.umaysoba.com, in accordance with the applicable consumer protection legislation of the Republic of Türkiye.

1.2 Buyer Information
The Buyer's name, surname, billing information, delivery address, telephone number, e-mail address and other information provided during the ordering process shall be deemed correct as declared by the Buyer.
The Buyer acknowledges and accepts that all information provided during the ordering process is accurate, complete, and up to date. The Seller shall not be held liable for any delay, failed delivery, or other consequences arising from inaccurate or incomplete information supplied by the Buyer.
2. Subject of the Agreement
This Agreement governs the sale and delivery of pellet stoves, wood stoves, coal stoves, fireplace stoves, stove accessories, and other products ordered electronically by the Buyer through the website www.umaysoba.com. It defines the rights and obligations of both parties in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.
By completing an electronic order, both parties acknowledge that this Agreement becomes legally binding and enforceable under the applicable laws of the Republic of Türkiye.
3. Definitions
For the purposes of this Agreement:
- Seller: Refers to Umay Soba, the company offering products for sale through its website.
- Buyer: Refers to any natural or legal person purchasing products through the website.
- Products: Refers to pellet stoves, wood-burning stoves, coal stoves, fireplace stoves, stove accessories, and all other products offered for sale.
- Website: Refers to www.umaysoba.com.
- Distance Sale: Refers to a sales transaction completed electronically without the physical presence of the parties.
- Law: Refers to Turkish Consumer Protection Law No. 6502.
- Regulation: Refers to the Regulation on Distance Contracts currently in force.
4. General Provisions
Before completing an order, the Buyer confirms that they have read and understood all preliminary information regarding the essential characteristics of the products, prices, payment methods, delivery conditions, shipping information, right of withdrawal, warranty conditions, and other relevant information available on the website.
Product descriptions, technical specifications, images, and prices displayed on the website are regularly updated. However, slight variations in product colors may occur due to differences in screen settings, monitor calibration, or photographic lighting conditions.
The Seller reserves the right to correct typographical errors, technical inaccuracies, pricing mistakes, stock availability information, or other unintended errors appearing on the website, provided such corrections comply with applicable legislation.
Unless otherwise stated, all products offered by Umay Soba are supplied as new, unused, and manufactured in accordance with applicable quality standards.
The Buyer agrees that electronic order confirmations, payment records, system logs, e-mail correspondence, and other electronic records maintained by the Seller may be used as legally valid evidence in the event of any dispute.
5. Orders and Payment Terms
By placing an order through www.umaysoba.com, the Buyer agrees to purchase the selected products at the price displayed on the website, together with any applicable shipping charges, payment terms, and other conditions specified during the checkout process.
An order shall become effective only after the payment has been successfully completed and confirmed by the Seller. For payments made via bank transfer (EFT/Wire Transfer), order processing will begin once the payment has been credited to the Seller's bank account.
The Seller reserves the right to review, suspend, or cancel an order in the event of technical errors, pricing inaccuracies, stock shortages, suspected fraudulent activity, or circumstances beyond its reasonable control. In such cases, the Buyer will be informed promptly and any payments received will be refunded in accordance with applicable legislation.
Prices, promotional campaigns, and discounts displayed on the website may be modified or discontinued without prior notice unless an order has already been confirmed.
6. Product Delivery
Purchased products will be prepared and shipped as soon as reasonably possible, subject to stock availability. Deliveries will be made to the address specified by the Buyer during the ordering process through the Seller's contracted shipping partners.
Unless otherwise stated, products will be delivered within the maximum legal delivery period of thirty (30) days. The Seller shall make every reasonable effort to deliver products earlier whenever possible.
The Seller shall not be responsible for delays or failed deliveries resulting from incorrect, incomplete, or outdated delivery information provided by the Buyer.
If the Buyer is unavailable at the delivery address, the shipment shall be handled according to the procedures of the shipping company. Any additional delivery or storage charges resulting from unsuccessful delivery attempts may be the responsibility of the Buyer.
7. Shipping Inspection and Damaged Deliveries
Heating stoves and stove accessories are products that require careful transportation. Therefore, Buyers are strongly advised to inspect the external packaging before accepting delivery.
If the package shows visible signs of damage, such as dents, tears, moisture, crushing, deformation, or impact, the Buyer should request an official damage report from the shipping company before accepting the shipment.
If the shipment is accepted without any reservation or damage report, the products shall be deemed to have been delivered in good condition. However, if concealed transport damage is discovered after delivery, the Buyer is encouraged to contact Umay Soba without unnecessary delay.
Providing clear photographs and videos showing the damaged product and its packaging will assist in resolving the claim more efficiently.
8. Product Availability
All products displayed on the website are offered subject to stock availability. Although inventory information is updated regularly, temporary discrepancies may occur due to simultaneous purchases, supplier delays, or inventory adjustments.
In such cases, the Buyer may choose to wait until the product becomes available again, accept an equivalent alternative product, or cancel the order and receive a full refund.
9. Force Majeure
Neither party shall be held liable for delays or failure to perform obligations arising from events beyond reasonable control, including but not limited to natural disasters, fire, war, pandemics, transportation disruptions, government actions, supplier failures, or other force majeure events.
If such circumstances prevent timely delivery, the Buyer will be informed as soon as reasonably possible and may choose to cancel the order, receive a refund, request an alternative product, or wait until normal conditions resume.
10. Product Installation and Proper Use
For safe, efficient, and long-lasting operation, all heating products should be installed and used in accordance with the instructions provided by the manufacturer.
Heating performance may vary depending on chimney installation, ventilation conditions, fuel quality, and installation practices. Performance issues or damage resulting from improper installation or incorrect operation shall not be considered manufacturing defects.
During the initial use of painted stove products, a temporary odor or light smoke may occur while the protective coating cures under high temperature. This is a normal characteristic of newly manufactured heating appliances and shall not be regarded as a product defect.
Only the fuel types recommended for the specific stove model should be used. Damage resulting from the use of unsuitable fuels or improper operation may not be covered under the product warranty.
11. Warranty and Product Liability
All products supplied by Umay Soba are covered by the warranty provisions applicable under the consumer protection legislation of the Republic of Türkiye. The warranty shall remain valid only when the product has been installed, operated, and maintained in accordance with the user manual and the manufacturer's recommendations.
To ensure optimum performance and long service life, Buyers are advised to follow all instructions regarding installation, chimney connection, ventilation, fuel selection, cleaning, and routine maintenance.
The warranty may not apply in the following circumstances:
- Failure to follow the instructions contained in the user manual.
- Damage resulting from the use of unsuitable or unauthorized fuel types.
- Performance problems caused by an improperly designed, installed, or maintained chimney system.
- Damage caused by impact, dropping, misuse, negligence, or improper transportation after delivery.
- Damage resulting from fire, flooding, earthquakes, lightning, or other external events beyond the Seller's control.
The warranty shall also become void if the product has been modified without the Seller's prior written approval, including but not limited to welding, cutting, drilling, repainting, structural alterations, replacement of original components, or any other unauthorized technical intervention.
During the first few uses of painted stove models, a temporary odor or light smoke may occur while the protective coating cures under high temperature. This is a normal characteristic of newly manufactured heating appliances and shall not be regarded as a manufacturing defect.
12. Right of Withdrawal
In accordance with Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, the Buyer has the right to withdraw from the purchase within fourteen (14) days after receiving the product, without providing any reason and without incurring any legal penalty.
To exercise the right of withdrawal, the Buyer must notify Umay Soba in writing or by using another legally acceptable durable communication method before the withdrawal period expires.
Products returned under the right of withdrawal should be complete, unused beyond normal inspection, suitable for resale, and returned together with all supplied accessories, documentation, and, where reasonably possible, the original packaging.
13. Return Conditions
Whenever possible, returned products should be shipped in their original packaging to help protect the product during transportation. Damage to the packaging alone does not automatically eliminate the Buyer's right of return; however, if the product itself has suffered damage that significantly reduces its resale value, the return request will be assessed in accordance with applicable consumer legislation.
To facilitate the return process, Buyers are requested to include the original invoice, warranty certificate (if provided), user manuals, accessories, and any promotional items supplied with the order.
Once the returned product has been inspected and approved, the refund will be processed within the legal period using the same payment method originally used for the purchase, unless otherwise agreed between the parties.
14. Products Excluded from the Right of Withdrawal
In accordance with applicable legislation, the right of withdrawal may not apply to products that have been manufactured or customized according to the Buyer's specific requirements, products that have been permanently installed, products that cannot reasonably be returned due to their nature, or products otherwise excluded by law.
Likewise, products that have been intentionally damaged, modified, improperly used, or altered after delivery may not qualify for return or refund.
Except for the legal exceptions expressly provided by law, all consumer rights granted under the applicable legislation remain fully reserved.
15. Protection of Personal Data
Personal data provided by the Buyer during the ordering process shall be processed and protected in accordance with the Turkish Personal Data Protection Law No. 6698 (KVKK) and all applicable legislation.
The Seller shall process the Buyer's personal information solely for purposes including order processing, payment verification, product delivery, after-sales services, customer support, warranty procedures, legal obligations, and customer satisfaction.

16. Electronic Records and Evidence
The Buyer acknowledges and agrees that electronic records maintained by the Seller, including order confirmations, invoices, payment records, e-mails, shipping information, website logs, and other electronic documents, shall constitute valid evidence in accordance with the applicable legislation of the Republic of Türkiye in the event of any dispute.
17. Resolution of Disputes
Any disputes arising from this Agreement shall be governed by the laws of the Republic of Türkiye.
For disputes falling within the monetary limits announced annually by the Ministry of Trade of the Republic of Türkiye, the competent Consumer Arbitration Committees and Consumer Courts located at the Buyer's place of residence or where the transaction took place shall have jurisdiction.
Nothing in this Agreement shall limit or exclude any mandatory consumer rights granted under applicable law.
18. Electronic Acceptance
Before completing an order through www.umaysoba.com, the Buyer confirms that they have read, understood, and electronically accepted this Distance Sales Agreement, the Preliminary Information Form, the Privacy Policy, and all other legally required information provided on the website.
Electronic acceptance shall have the same legal effect as a handwritten signature under the applicable laws governing electronic commerce and consumer transactions.
19. Entry into Force
This Agreement shall enter into force immediately upon the Buyer's electronic confirmation of the order.
By completing the purchase, the Buyer declares that they have carefully read, understood, and accepted all provisions contained in this Agreement.
